Examining Title to Property
As we learned in Unit 6, good title is usually what is promised by way of a warranty deed to real property. Because of this, a title examination must be conducted to ensure there are no encumbrances or liens on the property. Besides a review of the chain of title, there are other places one should look in order to ensure there are no encumbrances or liens on the property. Writing is a very large part of the work performed in the legal field. In order to succeed as a legal professional, one must be able to transform research into well-written documents. Legal writing is different than other writing styles, so it is necessary to explore what elements are expected in legal writing.
Compare and Contrast
Organization is key in all legal writing. As we have seen, some legal documents will have structured exterior organization while other legal documents will use an interior structure to create the flow and clarity. Using Westlaw or your state legal resources available online, locate a form or rule defining format in your own jurisdiction. Would you expect these formats to vary across jurisdictions? Which legal documents will be governed by Rules of Court and which kinds will be up to the writer?
