The USA Patriot Act has been a hotly debated document. Regardless of opinion or bias, as you have learned there are Constitutional constraints on what Congress can and cannot enact. This case study is an opportunity to look at the USA Patriot Act through a Constitutional lens.
• Explain the act and its objective.
• What are the Constitutional implications for the clauses covered in the Act?
• How was congress able to enact an Act with such arguable implications?
• What are the different perspectives of the different pillars of the criminal justice system, in other words, is the Act viewed differently from the Court, Correction, and Law Enforcement perspectives? Explain.
