Agency & Employment Law

Question #1 (5 points):
S&T Corporation retained Brooke to find sources of raw material for its products. (1) Identify and explain

the three types of contractual authority Brooke may have. (2) Identify and explain each instance when

Brooke may be held liable for the contract depending on the level of disclosure to the supplier (what is

each type of disclosure and the accompanying liability?).
Question #2 (5 points):
Bart has been hired to do some work for Martini Enterprises.

  1. What seven factors (from the textbook, introduction to business law 6th edition,pp 316-335,pp 336-346)
would a court consider in determining if Bart is an employee or an independent contractor?
  2. Why does the designation matter from a physical tort liability perspective? How and when is a principal

liable versus an employer?
Question #3 (5 points):
Jeri is a national sales manager for Drip Faucets. She is about to have a baby and wants to file for leave

under the Family and Medical Leave Act.
What two key pieces of information will factor into whether she is entitled to leave (note that we already

know that she has a triggering event, i.e. being pregnant; and assume that a sales manager is a full-time

position).
If she is entitled to leave, what are the three requirements for Drip with respect to what they have to do for

her?
How does the statute (1) benefit and (2) adversely impact Drip as the employer? (Note, this answer isn’t in

the text. I am looking for your own thoughts.)
