Richard wishes to learn to drive, and contracts with Saoirse, a driving instructor, for a dozen lessons, for which he pays in advance. Saoirse has standard terms of business, which are displayed in the car she uses for driving lessons, and which include a clause stating that "Saoirse is under no liability to her client for any accident which might, through reasonable care by the client, have been avoided". On Richard's second lesson, as he is driving Saoirse's car under her supervision, he is directed by Saoirse onto a busy main road. Panicking at the heavy traffic, he crashes the car into a traffic light, despite Saoirse‘s best efforts to stop him. Richard is significantly injured. Saoirse, who was unharmed, indignantly denies that the crash was her fault.
