Order Description
Word Limit: 1,500 words for each essay question. You have to answer BOTH questions.
1) Critically analyse and distinguish the role of case law in the French and English Legal System
2) Pick two countries (other than the UK) where the Common Law is either the main legal system or part of a hybrid system of law and focus on the following issues:
a) Discuss the main reason(s) for their adoption of the Common Law system;
b) Analyse to what extent to which it mirrors the Common Law system of the UK;
c) Critically evaluate the other major influences in that jurisdiction, if there are any.
note your coursework must be referenced. The system recommended is the Numeric system (Footnotes). The Numeric system is to all intents and purposes the OSCOLA system. Please also note that the Numeric (OSCOLA) system is the better system to use for referencing case law. Footnotes will not be counted in the word limit of the coursework as long as they are only references to legal authorities (cases, statutes, journal articles etc) and not used to explain or develop arguments.
