What is the 21st Century Cures Act's Information Blocking Rule?

 

The 21st Century Cures Act, signed into law in 2016, aims to accelerate medical product development and bring innovations to patients faster. A key component, with enforcement phases that began in 2021 and continue to evolve, is the Information Blocking Rule. This rule, implemented by the Office of the National Coordinator for Health Information Technology (ONC), broadly prohibits healthcare providers, health IT developers, and health information networks (known as "Actors") from engaging in practices that are likely to interfere with the access, exchange, or use of electronic health information (EHI). The goal is to promote interoperability and give patients more control over their health data.

In essence, if EHI can be legally shared, it generally must be shared unless one of the limited, defined exceptions applies (e.g., preventing harm, privacy, security, infeasibility). This includes, but is not limited to, clinical notes, lab results, imaging narratives, and discharge summaries.
