The Second Amendment Order Description ANALYTICAL PAPER TOPIC: Second Amendment ISSUE: Most of you are aware of the tragic shooting at New England’s Sandy Hook Elementary School in December 2012 where a lone gunman killed 27 people. 20 of those shot dead at the school were children. This issue gripped the country and made gun control and gun rights a centerpiece of American politics in 2013. Subsequent to that shooting other mass or public shootings have occurred. While many feel the Second Amendment of the United States Constitution is clearly written and confers unquestionable private gun ownership rights, others believe the opposite, or at the minimum, that it is a nuanced civil liberty worthy of great analysis. Consider the following: -The Second Amendment’s purpose was to establish a militia to maintain the public order. -“Militia” was intended to mean a police force. -Therefore, the people’s right “to keep and bear arms” was associated with the participation in state militias. Given these historical realities that were the background and context for the Second Amendment, how should the country move forward with this issue? If most people feel the right to possess arms was for protection from the government, where then do they point to in the Constitution for that specific power and right? 4. From an objective point of view, how does “strict constructionism”, “originalism” and “Modernism” relevant in terms of affecting the outcome of a constitutional analysis of the Second Amendment?
