ISSUE: Does a Women Have a Constitutional Right to an Abortion?
You are the Chief Justice of the L.B. Supreme Court and have to write the Legal Opinion on whether or not a woman has a constitutional right to an abortion.
Roe v. Wade first provided the answer to this question in the affirmative. Yet, just this past June of 2022, in Dobbs v. Jackson Women’s Health, the Supreme
Court reversed itself holding that a woman does not have a constitutional right to an abortion, and that such right should be left up to the individual states.
Your job is to decide whether or not you agree with Dobbs and what you believe to be the correct answer to the above issue.
You should present the strongest arguments on both sides of the issue. Clearly label and argue both the “Yes” and then the “No” opinion to this issue. Provide
the best legal, ethical, and moral arguments for each side in your answer. Be sure to include relevant case law and any constitutional support for both sides
of the issue. You may then give your personal position on the issue. You should include a historical overview of the laws and cases involving abortion.
Provide concrete analysis and your opinion as to what are both the strongest legal positions, as well as the best ethical arguments on this topic.
The paper should be 13-15 double-spaced pages in standard font with standard margins. You need to use correct citation, references, grammar, and spelling.
You should use endnotes, not footnotes. Provide a List of References at the end. I suggest breaking down your research paper into sections and labeling
each section for organization and easy reading. Please number the pages!
