a. The author makes the statement “Nearly every aspect of the sporting arena invariably
deals with IP rights such as copyright, trademarks, patents and image rights.” Explain,
by reference to relevant statutory provisions, the requirements for and the nature of the
exclusive rights granted for copyright, trademarks and patents. Classify and
differentiate the nature of protection conferred by each of these rights.
b. By reference to each of the types of IP rights discussed above, i.e., copyright,
trademarks and patents:
i. Discuss and demonstrate examples of how each of these rights may be relevant
in sport, and how these rights are commercially important in sport; and
ii. Discuss and analyse the benefits to sports companies and concerns of sports fans
respectively arising on account of the recognition of intellectual property rights
in sport.
