Law

You are a lawyer in a fictional country called Nambia.
A family of a deceased person consults with you regarding the death of the father in the family. He was the only source of income for the family. His death resulted from a number of factors. His first symptoms of ill health started with obesity and diabetes. He later developed Coronary artery disease as well as colon cancer.
He went to the hospital regularly for treatment of those conditions but his most recent visits to the hospital were caused by skin, eye, and respiratory irritation.
He lived near a CAFO (Concentrated Animal Feeding Operation) and worked inside one as well. The name of the CAFO was the BIG Slaughter Corporation which a wholly owned government operation.
While receiving treatment in hospital it was also discovered that he had contracted Methicillin-resistant Staphylococcus aureus (MRSA). The exact place where this was contracted is not clear.
However, shortly after this diagnosis he passed away as a result of the impact of the MRSA combined with his other poor health conditions.

His family who also live near the CAFO and consume meat from the CAFO have also acquired MRSA. They also eat from the same three fast food outlets as did he and they also suffer from obesity and diabetes.

There are concerns about the environment in and around the CAFO due to water quality because of both the increased volume of waste and to contaminants that may be present (e.g., antibiotics and other veterinary drugs) that may have both environmental and public health importance. Based on available data, generally accepted livestock waste management practices do not adequately or effectively protect water resources from contamination with excessive nutrients, microbial pathogens, and pharmaceuticals present in the waste. Impacts on surface water sources and wildlife have been documented in the area. Potential impacts on human and environmental health from long-term inadvertent exposure to water contaminated with pharmaceuticals and other compounds are a growing public concern. This includes air and water contamination, the rise of antibiotic-resistant bacteria in livestock.
His family want to institute action against the government and three fast food chains as well as the CAFO where he worked.
They argue that many of the ailments were caused by diet which was the Standard American Diet (SAD) and was largely consumed at the three fast food outlets which they wish to sue. The three are Marc Fat, Burger Fat and Fat Guys Burgers. In addition to this they believe that the government should have educated all of them on the risks associated with this diet or at the very least passed legislation warning of the risks associated with this type of diet..

Furthermore they are concerned with the environmental impact of the Concentrated Animal Feeding Operations (CAFOs) on the immediate environment. They want you to consider at least the following 1. Air Pollution, 2. Deforestation, 3. Water Pollution, 4. Monocultures, 5. Greenhouse Gas Emissions and 6. The Impact of Antibiotic use in Concentrated Animal Feeding Operations on the food sources of humans.
The family believe that there is a link between the CAFO’s, the food that was being promoted, the living and working environment and all the ailments from which the deceased suffered.
